Abstract (EN)
Rapid transitions and developments at medical science lead to make compulsory researches instead of traditional medical methods. New medical methods categorized into two; medical experiments (tests) targeted towards treatment and scientific aimed, namely clinical tests, medical treatments. By this way for the provision of the legal appropriateness of medical experiments? on human being; more rigid and special provisions are needed than the provisions of traditional medical interventions legal conditions. Realization of experiments, on human, deteriorate the individual rights as body integrity, health right; but being made medical interventions legal convenience to procedures and basis of adopted medical science not suited to the provisions of treatment aim and having medical imperativeness.Evaluating the medical science current stage by the help of researches and experiments; it is not possible to reject the implementation of new medical methods. But the volunteer people that allow methods application on the bodies should be protected from the research doctor, and the supported research institution and institutions; for that reason some special provisions are searched for the legal convenience of new medical methods. With those conditions like; realization by the professional doctor, comprehensive and detail enlightenment, getting clarified consent, making benefit and risk analysis, making the control of ethic committee; new medical methods, application is being appropriate to the law.It is influential to make analysis on the framework of international and national arrangements provisions on the aspect of the new medical methods convenience to law and the protection of human beings, faced with the application of new medical methods. At these study traditional medical interventions compared with the new medical methods; and the deficiencies tried to be analyzed with the examination of national and international arrangements in respect of new medical interventions reasons of legal appropriateness.Key Words: Cure-aimed Medical Experiment, Scientific aimed Medical Experiment, Cure Agreement, Enlightenment, Consent
