Abstract (EN)

A Management Contracts is a kind of contract wheTebyTperorT, real or body corporate, enters into a contractual obligation towards a recipient of management services, who is a real person or a body corporate, to manage an industrial or commercial concern, partially or completely, in exchange for consideration. In Turkish Laws, there are no provisions for management contracts, either in the "Miscellaneous Contract Types" section of the Law of Obligations, or in the form of a special Act In our view, management contracts are atypical mixture contracts accommodating the features of service contracts, representation power contracts, work contracts, and know-how contracts. Managers and the recipient of management services are the two contractual parties involved, and both parties can be either real persons or body corporate. In line with industrial and technological developments taking place during the recent years, business enterprises have become rather large and complex entities. This situation has given rise to a multiplicity of organisations and management forms. Management Contracts can be viewed as a product of this multiplicity. These kinds of contracts are more frequently encountered in the international trade relations. This study examines Management Contracts. VI
