Abstract (EN)

According to the Ottoman legal system, the determination and distribution of the goods and property left behind by the deceased are among the duties of the judges. In the dictionary "the remaining; The word 'muhallefat'', which is the plural of muhallef, which means geriye left behind geçer, is replaced by tereke and metrûkât in documents. The main subject of our thesis is who is working at Gaziosmanpaşa University in Tokat Prof. Dr. Alpaslan Demir's Tokat Museum "Tokat Museum incoming and outgoing documents in the registry" as a result of research conducted in the Merzifon Şer'iyye Register 1867-79 are records of the land. In this study, detailed information was given about the provisions mentioned in the 112 tereke record and this information was evaluated both in terms of quantity and quality. Thesis; introduction consists of four chapters and results. In the introduction part of our thesis, a general evaluation is made and after the information is given, the first part is started. In the first part, the aim, method and the course of the study are given. In the second part, information about the Sharia registers and their place and importance in the Ottoman Empire is given. In the third section, how the land registrations are made and the information in the land are given to the registers. In the fourth and last part, the definition of the heir and the heir according to Islamic law is made and information about the findings in the estate is given.
