38th matter of 2709 numbered and 1982 dated of our constitution is about crime and punishment?s bases. As in paragraph thesis-based principles that we try to explain the principles of contemporary law and indispensable in terms of human rights and is now the world has become the default.Certainly anybody doesn?t want mistrated for crime. But in ordinary life someone commit?s a crime than the another one to be crime?s victim. The state will protect the rights of victims. Anymore take a person's own right it is an approach not adopted. But the government interferes in the event; so the guilty person's right comes up.To commit a crime is a behaviour that is undesirable and felt odd by the society. The crime and guilty disapprove by ethics and religious rules without law?s rules. But what we shouldn't miss that the one who commits the crime is also a humanbeing. The guilty must have the basic rights because of the humanbeing.Crime and guilty?s basic foundation in judges process appeared in our constitution?s 38th matter of dated 1982. These principles are the principles we take as our thesis, in terms of each policy in the context of human rights and criminal law have to explain.We tried to confirm these principles what they mean by analyzing from constitutional perspective which are taking place in our constitution,but mostly not explained enough in our constitution law books.
