Abstract (EN)

The Republic of Azerbaijan, entered into democratization course after gaining its independence following the dissolution of the Soviet Union in 1991. The Republic of Azerbaijan, with the purpose of maintaining its stability and democracy from the first day of independence and by entering into the democratization course, started to take important steps in the direction of adoption of the Constitution of independent Republic of Azerbaijan. Brought to referendum on 12 November 1995 and adopted with a big support from Azerbaijani people, the Constitution of the independent Republic of Azerbaijan is still in force. The 1995 Constitution of the Republic of Azerbaijan, guided by the principle of the separation of powers, embraced the principle of strong governance and provided the Head of State with broad authorities. Established in May 1990, the Head of State institution, standing at the center of constitutional arrangement of Azerbaijan, was specified as the head of the state and execution. In this work, regulations concerning the institution of Head of State, which is at the center of constitutional and political systems of Azerbaijan, are handled and examined in detail. Consisting of Consisting of three sections, in the first section of this work, the constitutional development of the Republic of Azerbaijan in a century-old historical period is handled and examined in general terms. In the second section, on the basis of the structure of execution regulated by the Constitution of Azerbaijan and the relations between legislative and executive powers, the governmental system adopted by the Republic of Azerbaijan is put forth. In the third and main part of this work, all regulations concerning the institution of the Head of State of the Constitution of Azerbaijan, specifically by handling the authorities of the Head of State, are examined and the impact of up-to-date amendments to the 1995 Constitution on the institution of the Head of State is evaluated.
