Abstract (EN)
Introduction and Purpose: Types and points of the injuries, whether they cause sequelae and the severity of the injuries are among the most important factors for determining the punishment for injuring cases. This study aims to evaluate 126 medical cases retrospectively. These cases were reported about weakening or loss in the function of one of the senses or organs. It is also aimed to determine the problems encountered in the preparation of the report and to determine the proportional equivalents of the injuries and sequelae in the "American Medical Association Permanent Disability Evaluation Guide", and to evaluate national and personal ix differences by the Department of Forensic Medicine and to compare the results with the "Regulation on Determination of Working Power and Profitability in Profession" chart. Finally, a list of suggestions and amendments to eliminate the contradictions according to the results is presented as a conclusion. Materials and Methods: 126 medical cases who were reported about weakening or loss in the function of one of the senses or organs were examined retrospectively, these patients in forensic reports are classified according to age, gender and by using the "American Medical Association Permanent Disability Assessment Guideline" and "Regulation on Determination of Working Power and Profitability in Occupation". Percentages of loss is defined as "continuous weakening in function" if it is between 10-50% and as "loss of function" if it is above 50%. These data were recorded in medical opinion data form. Analyzes were evaluated in SPSS Windows, version 22. Findings: Out of the 126 medical cases, 88.1% are male and 11.9% are female. Average age is 40.5. Standard deviation is ±16.9. Traffic accidents are the highest reason for consultation (34.9%). The highest injury rate are injuries in the eye (27%). The rate of life-threatening injuries is low in isolated upper extremity injuries, but it is higher in abdominal injuries compared to other parts of body. There is a significant difference between the percentages of loss obtained from the regulations and charts used when we consider the injury points (p<0.01). Conclusion: It is necessary to rearrange "The Guide for the Evaluation of Injury Crimes Defined in the Turkish Penal Code in terms of Forensic Medicine" in a scientific, objective and reliable ways and in line with international standards. This rearrangement makes possible to evaluate the results of anatomical loss and functional limitation together. Internationally valid and reliable applications and scales should be used, and the results should be calculated based on functionality. In terms of criminal law, "Regulation on Determination of Working Power and Profitability in Profession" is not sufficient and up-to-date, and it is not possible to use it in practice. It is obvious that it is not possible to use the "American Medical Association Permanent Disability Evaluation Guide" in its entirety, but it is x especially important to apply the chapters defining some orthopedic disorders when a new guide is prepared or revising the current one.
