Abstract (EN)
EMRA, which had been found as Electricity Market Regulatory Authority by Electricity Market Law numbered 4628, then named as Energy Market Regulatory Authority after the Natural Gas Market Law numbered 4646. EMRA which is an independent administrative agency has been authorized to regulate, monitor, audit and apply sanctions in natural gas market. Regarding natural gas, the fluctuations at the prices of which has great impact on the whole economy, it is essential to analyze the administrative sanctions and misdemeanors, having functions of penalization and prevention, in order to achieve proper functioning of the market and reach the targets foreseen at Natural Gas Market Law numbered 4646.In this study, the exclusion attitude from depenalisation the common principles dominating administrative sanctions and misdemeanors in many legislations, resulted from foundation of independent administrative agencies, reflections of those principles on Misdemeanors Law and in this frame, the misdemeanors and administrative sanctions are analyzed. As a result, the points that needs to be considered when deciding to force administrative sanctions, are not only limited to Natural Gas Market Law numbered 4646 and secondary legislation, but also the main principles of the misdemeanors jurisprudence and common principles of the law.
