Electronic tender by Public Procurement Law No: 4734

As a result of the constantly developing technological developments on a global scale, there have been many changes in the field of law. Among the relevant changes are public tenders concerning public expenditures. Public Procurement Law has undergone a radical change within itself and undergone many changes and innovations. Electronic Public Procurement Platform (EKAP), which is a more modern system in terms of meeting the needs of the digitalized social order in the public and the continuity of public services, has been established. In this relevant study, as a result of this radical change, which has an effect on tenders concerning all public expenditures carried out throughout the country, what happened compared to the classic tender period will be evaluated by considering its negative and positive aspects in line with the Public Procurement Law No. 4734 and related regulations. By determining the positive aspects of the change in question, it will be aimed to ensure continuity of this effect; With the determination of negative aspects, a solution will be sought against the relevant problems. The Public Procurement Law is considered as a whole and the comparison of the classic tender period with the electronic tender period, in line with the court decisions and the decisions and reports published by the Public Procurement Law, the adequacy of the relevant change will be evaluated with its cons and pluses. In the last part of our study, the application of artificial intelligence, which comes to the fore with its popularity today, to public procurement law as we will present it as a recommendation, will be discussed.
