Abstract (EN)

In this study, the characteristics of competition, which is a basic principle of the Public Procurement Law No. 4734 and the main purpose of the tender, have been researched. In this context, it has been evaluated that the question of what kind of competition is sought in public procurements within the scope of the Law serves as a guide. It has been understood that it is functional to examine the relationships of competition with other principles in finding the answer. The competition principle, which makes it mandatory to increase participation in the tender with free will and to avoid actions that prevent this, is essential for obtaining the subject of the tender at the most reasonable price from the most capable person as a result of fair competition. It has been determined that the competition, which is the main purpose of the tender, is in interaction with other principles and has transparency, equality, and suitability characteristics in terms of tenders within the scope of the Law. It is determined that if one of the qualities of the competition that is intended to be formed with the tender is damaged, it will also endanger the others, making it difficult to achieve the purpose of the tender. Therefore, it is evaluated that it is a necessity to carry out the tenders with the established qualities in order to achieve the purpose of the competition.
