Abstract (EN)

Some of the services that society needs are met by the public administration. Public administration has to fulfill by public servants form the basis of the administration of these services. Society takes fulfilling the trust against the public administration services. To ensure the continued confidence that the community has an important place in the public administration. It has been preserved with confidence in the law and sanctions. One of these laws contained in Article 257 of the Turkish Penal Code, Position Abuse is a crime. Criminal malfeasance, Book 2 of the Turkish Criminal Code, "Crimes Against Nation and State" of Part 4, entitled "Offenses Against the reliability and functioning of the Public Administration entitled" located in Section 1. Malfeasance crime is a crime committed by specific only to public officials who participated in public activities. Beliefs and shaken by protective legislation in terms of confidence Un having no sanctions maintaining confidence than the specific types of crimes committed against the reliability of the public administration was established to protect. Overall it is a complementary offense.
