Abstract (EN)
The definition of the urban transformation has a very large context that are dimensions such as physical, spatial, social and economical because of there are a lot of the risky buildings under the disaster risk and it finds the common implementation area in the natural disasters that bring about the heavy damages in Turkey. With these aspect, the urban transformation has an extensive and a large concept that contains some areas of law such as Administrative Law, Zoning Law, Property Law and Private Law. Apart from that, the urban transformation that has common implementation area and many aims, took on different legal dimension with in accordance with the law no 6306 "Law on The Transformation Areas Under The Disaster Risk". Before the law become effective, the urban transformation implementations and similar implementations had been found in various legislations implicitly or explicitly and discursively. The law, is known as the Urban Transformation Law in public opinion became effective gazetting on May, 31, 2012 with the law no 6306 and included all the other legislations. With being effective the Law No. 6306, the urban transformation implementations and methods require not only the Administrative Law, but the orher legislations and legal issues to evaluate together extensively and integrative. In this study, firstly it is examined the urban transformation concept, its general history in Turkey and in the World and then, the legalised case of the Urban Transformation Law with the Law No. 6306. Secondly, it is studied that the transformation implementations, progresses and its results in detail acoording to the Law No. 6306. In this context, it is stated that the implemenations that are done in the frame of the urban transformation, especially, in relation to the faced problems in the progress of the risky building assessment, demolition and transformation prosecces during the implementation . In related to these problems, it is explained the sample decisions of Courts of First Intance, Administrative Courts and Councilof State, and it is evaluated the governing jurisdictions' comments. This study aims the solution of the faced problems during the implementation of the urban transformation in the light of the regarded governing jurisdictions' decisions.
