The termination of leasing contract in accordance with the law numbered 6570

The subject of this master thesis is `The Termination of Leasing Contractin Accordance With the Law numbered 6570? and the concept of thetermination of of leasing contract has been handled only in terms withimmovable property and on the basis of the Law numbered 6570 exceptconsidering the rent of the product. Although the examination has beencarried out on the subject mentioned on the title, since the termination ofleasing contract has been drawn up in the Code of Obligations which has ageneral law charecteristic, the subjects of the examination has been handledby comparing with the regulations in the Code of Obligations.The law of `GKHK numbered 6570' which is the basis of the thesis hasthe purpose of the protection of the lessee who is more powerless than thelessor in terms of social and economic aspects and because of this socialprotection purpose, the regulations have been drawn up mostly in aid of thelessee. However, the fact that the balance, which is depraved in favor of thelesee, causes the grievance of the lessor has become a constant point interms of both case laws of the supreme court and doctrine opinions. Themalicious usage of the regulations which are in favor of the lessee andsubsequently the grievance of the lessee have caused this result. Although,present regulations are extremely in favor of the lessee, in the Code ofObligations equality of this balance has been aimed and legal authoritieshave been trying to equal this balance by considering this change .Finally, we would like to mention that the termination of leasing contracthas been handled in the framework of the scope mention in the firstparagraph following the reasons in the related Law and on the basis of thechange of the benefit balance mentioned in the second paragraph.
