The effect of the Law No. 6698 on the Protection of Personal Data on the relationship between employees and employers

The purpose of this study is to examine the right to protect personal data, which has an old history but has recently become important in our country, in terms of employee- employer relationship, and to create an awareness of the scope of rights and obligations arising from data protection law on employees and employers. In this context, the effect of the process after the enactment of the Personal Data Protection Law numbered 6698 on the employee-employer relationship has been examined under four main headings in our study; we tried to touch upon the current effects of the personal data protection law by including the decision made by the Personal Data Protection Board and the published public announcements, to the extent appropriate to the topics covered in our study. In the first section, the term of personal data and national and international regulations on the personal data protection have been mentioned; in the second part, the relationship between the personal data protection and labour law, the features of the employment agreement within the scope of the general principles of data protection law and the reasons for compliance with the law, and the data processing activities used in practice have been tried to be explained and in the third section, the obligations and rights of the employees and employers are examined and in the forth section, the administrative ways that an employee can apply in case of violation of his personal data, legal sanctions provided for in terms of private law and criminal sanctions under the Turkish Criminal Code have been tried to be discussed. We hope that our study will instil the importance of the term and right of the personal data protection to all employees and candidate employees who try to exist in business life, by accepting the usual workplace practices as the obligations of the employment relationship.
