Disciplinary penalty of dismissal from profession in accordance with decree law on disciplinary provisions No.682 for general law enforcement agencies

With Decree Law on Disciplinary Provisions for General Law Enforcement Agencies Number 682 entered into force on 23 January 2017, the disciplinary regime covering the personnel of Police, Jandarma and Coast Guard Agencies that conduct general law enforcement duty in the Republic of Turkey was re-regulated. Accordingly, the personnel of Jandarma and Coast Guard who had been subjected to Turkish Armed Forces Disciplinary Law number 6413 until Decree Law on Measures and Arrangement of Some State Agencies in accordance with the State of Emergency number 668 and dated 27 July 2016 entered into force, and the personnel of Police Department who had been subjected to Police Department Law number 3201 until Decree Law on Disciplinary Provisions for General Law Enforcement Agencies number 682 entered into force were gathered under one roof with a state of emergency law-amending ordinance. Other personnel who work in Police Department, Jandarma and Coast Guard and are subjected to Law No. 657 on Civil Servants were also added under this roof. Within this context, in this study which was prepared since the State of Emergency Decree Law number 682, which was put into effect in accordance with the state of emergency having been declared after coup attempt dated 15-16 July 2016 and entered into disciplinary legislation in an unusual manner, was a new regulation and implemented for the first time, disciplinary action for dismissal from profession, which was regulated the most detailed manner and implemented among disciplinary actions foreseen in Decree Law No 682, was preferred as special study topic. Doctrinal views, which occurred as a result that the subject matter punishment had been implemented similarly under the name of dismissal from armed forces in accordance with the Law no 6413 and Discipline Regulation of Police Department, were tried to be referred and the respective judicial verdicts were spoken in this study. While punishment to dismissal from profession was basically studied, similar punishments of dismissal from armed forces and civil servant were compared briefly.
