Abstract (EN)
In this study titled Civil Damage Claims in USA, European Union and Turkish Competition Law, the law suits for damage to be opened by natural persons who claim they have been sustained damage because of infringement of competition board?s rules for compensation of their loses are comparatively examined in terms of USA, EU and Turkish competition laws.In the first section of the study, the sanctions, related to public law and private law in competition law, are examined in general. In the second section of the study, existing arrangements and established practices related to claims of damage in the USA competition law that form the source of arrangements and practices about claims of damage in competition law are examined.In the third section of the study, the existing situation related to claims of damage in the EU competition law and the last related modification suggestions are examined. In the fourth section, the existing structure of claims of damage in the Turkish Competition Law and why they remain in the background especially against the public law sanctions and the existing structure of arrangements related to claims of damage in the Turkish competition law during the EU adaptation process and the subjects about in what extent it can be adapted with the EU law are examined.
