National security doctrines of the united states in the context of the USE of force in international law

Abstract (EN)

In this dissertation, the national security doctrines of the USA have been evaluated and criticized according to principles of using force in international law. In this context, it was evaluated that how the perception of security developed with the philosophy applied by the USA during its establishment period and whether is it suitable in terms of universal law rules that are tried to be applied in the international platform or not. First of all, concepts such as civil war, humanitarian intervention, jus cogens rules, self-defense, retaliation, opinio juris, war, self-determination, armed conflict, armed conflict law, recognition, national security are explained. Secondly, the visions of the national security doctrines of the USA have been evaluated by content analyzing methods to understand whether they overlap with the concepts of international law. Finally, US policies were evaluated in terms of international law principles. It has been aimed to see that Whether reflections of the USA's national interests and doctrines on the international area is compatible with international law According to the findings, The security policies adopted by the USA since its independence have a feature that does not avoid direct intervention when it required by his national interest. However, the general content of national security practices is parallel with the flexible power elements by considering the continuation of the UN system as a global hegemony and his duty toward the international community. Besides, as a result of this research, it has been determined that loyalty of the USA to the principle of multilateralism as much as possible and to act within the limits of the United Nations system has been changed.
