Abstract (EN)

Human is a social being and needs the family institution to continue its lineage. The purpose of the family is to raise children for the continuation of humanity. The linkage of the child is very important for the family and society. The issue of lineage has been carefully handled in our laws. It is regulated in both private law and criminal law. The proper establishment of the child's lineage with his/her parents will affect his/her whole life and is of vital importance for the child. Spouses who cannot have children normally may have children with the use of some techniques with the developing technology. Laboratory-assisted births have raised the problem of how to establish a lineage of children. The state had to criminalize this act, which concerns public order, due to the concealment of paternity due to various reasons, and the attempt to keep erroneous records by giving false information. In this study, the reflections of paternity in criminal law, medical law and private law are emphasized, and how paternity is determined and its importance for the individual and society are discussed. In the light of technological developments and forensic sciences, the issue of paternity has been tried to be clarified and various legal solutions have been suggested. The baby chest application, which is applied in different countries, is discussed in terms of establishing paternity. It has been evaluated in detail how the punishment of the crime committed in the decisions of the Court of Cassation has been applied in the crime of paternity, and forensic scientific methods that can be used in the clarification of this crime are included. Suggestions have been put forward to prevent the crime of altering the lineage of a child.
