Abstract (EN)

In this study, we deal with the effect of grammatical rules (nahw) on the derivation of the rulings from the Quranic juristic verses (ayat al-ahkam). We also investigate whether the grammatical rules are considered as contextual indication for the deduction of the rulings (ahkam) and we presented that where it stands in terms of hierarchical order among other evidences. As a result of this research, we drew a conclusion that the differences of grammatical interpretation of utterance have a direct impact on the ruling and nahw was never neglected. Nevertheless, the position of basing those rulings on the grammatical rules is only relevant to the indisputable subjects but, the opposite is more effective in the controversial issues. Thus, the grammatical rules are never accepted as one of the primary evidences, even if they are considered as indications for derivation of ruling. The reason for this is the existence of other interpretations that may lead to the accepted ruling. Islamic jurists used the grammatical norms as proofs, when they adopt divergent approaches in regards to other evidences, but the presence of numerous schools of nahw was an obstacle in front of reaching the final resolution to end the disputes. This work does not comprise the whole literature concerned ahkam al-Quran. We limited our research to Ibn al-Arabi's book for several reasons such as its being authored after the formation of schools of Islamic law and containing some comparisons between different schools, as well as giving preference to the rules of nahw. Thereby, we based our argument on this book, scanned it and identified the effect of nahw on Islamic law. In the 1st chapter, which is made up of an introduction and three sections, we mention the life of Ibn al-Arabi and his book as well as some information about the literature of ahkam al-Quran. In the 2nd chapter, we discuss some terms related to the relation between fiqh and nahw and the link between nahw and Quran. In the 3rd chapter, we identified the effect of grammatical rules on juridical rulings within the framework of selected samples from the book.
