Light the ECHR, right the fair trial and the Turkish administrative juristiction

The right to a fair trial, which is basic human rights and participate in many international documents and especially in ECHR, is important to advance administrative, civil and ciriminal law and asset state of law. The right to a fair trial designates rule about judgments. Administrative scope of the right to a fair trial in the judicial field, starting with the installation process transactions or actions of the administration, judicial decisions and continues until the full and complete implementation. Protection of this right is provided by the ECHR and the ECtHR decision. Other rights enshrined in the Convention regarding the protection and implementation by governments, with the full implementation of the right to a fair trial is possible. In this thesis, related to administrative judicial decision given by the Court under the right to a fair trial we reexamined, as a result of this decision by the administrative changes made to identify shortcomings in the judicial system are mentioned. In the thesis, 2010 constitutional amendments that entered with the institution of individual applications to the Constitutional Court made reference to the right to a fair trial under the decision of the Constitutional Court, had given samples, were examined. Thesis is divided into three sections. The first section contained in the documents of international and national nature and elements of the right to a fair trial were examined. In the second part of Turkish administrative justice system generally studied, examined the relationship between the Turkish administrative jurisdiction of the Court bound by the decisions of the ECHR had been mentioned. In the last section, the right to a fair trial by explaining the terms of the Turkish administrative justice, administrative justice system to solve the problems and the recommendations are mentioned on this glitch.
