Alternative dispute resolution methods in disputes arising from Family Law

Abstract (EN)

Alternative dispute resolution methodologies are generally the resolution of the disputes between people by an independent third person. Smooth solution of the disputes arising in the families, which are the base of the society, is very important for peace and comfort of the society. Therefore, in our study, the disputes arising from the Family Law, implementation of the provisions of "making agreement" regulated in the Article 35/A of the Legal Profession Act, "incentive for peace" regulated in the Article 7 of the Law on the Procedure and Procedure of Establishment of Family Courts in the alternative dispute resolution methods, and the "mediation" regulated in the Law on Mediation in the Civil Disputes are considered. Generally, as the issues on the Family Law are about the public order, the fields in which the parties can freely move are restricted. However, alternative dispute resolution methods can be applied on disputes regarding secondary results of divorce, such as alimony and compensation. Provision of resolution of the disputes arising from the Family Law in an effective and active way; the parties of the dispute should be encouraged to the alternative dispute resolution ways and applicability of the solution ways should be improved for decreasing the work load of the courts.
