Abstract (EN)
The subject of this dissertation is ?FAMILY DWELLING?. The dissertation consists of three chapters except introduction and conclusion parts.In Chapter I, family dwelling, the importance of family dwelling and the aim of the regulation are discussed and it is proposed to emphasis their specifics in the Turkish Law.In Chapter II, following the definition of family dwelling, the nature of the titleholder of the wife/husband is explained and the legal actions that are required the consent of the wife/husband within the scope of Article 194 of the Turkish Civil Code are presented.In Chapter III, the nature of the wife/husband?s consent that is required within the scope of Article 194 of the Turkish Civil Code, the consequences in case the consent is not granted and in such case the authorization request of the titleholder wife/husband from the court in accordance with Article 194/III of the Turkish Civil Code are analyzed as well as the nature of the annotation of family dwelling in the last chapter as regulated under Article 194/III of the Turkish Civil Code.
