In this thesis, it is examined the wide notion of the positive breach of contract. That's why the contractual obligations, general unperformence modalities, history of the positive breach of contract, the critical approaches to the notion are explained in a comparative approach. Also, with this thesis, one of main aims are to provide some knowledge about the results of positive breach of contract, right occuring in case of such breach, etc. and prescription
