Âmidî's Understanding of Ta'lîl

Abstract (EN)

The most common method of extending religious text in Islamic law is analogy. In order to be able to make an analogy, a common description must be defined between the origin which judgment is defined and the branch for which there is no judgment. Certain conditions must be met in order for the judgment to be attached to this description which is specified within certain methods. All these studies are expressed with the concept of ta'lîl in the literature of fiqh methodology. Although there is a consensus among methodologists on the acceptance of ta'lîl, it is not possible to talk about the consensus on the methods and necessary conditions to be used in determining the quality. A difference of opinion on this issue exists among the methodologists affiliated with the various sects, as it is found among the methodologists affiliated with the same sect. The most obvious example of this is the Shafi'i methodologist Sayfuddîn al-Amidi (d. 1233/631). This study, which deals with Al-Amidi's views on reasoning, consists of an introduction, three chapters and a conclusion. In the introduction, some general information about the research is given. In the first chapter, the nature of the relationship formed between the law and the ruling is determined from the third century of hijri, which is considered as the compilation century of the fiqh technique, to the seventh century which is accepted as the century of inquiry. In the second chapter, Al-Amidi's view of beauty and ugliness, which is accepted as the basis of the purpose of the Shari'ah provisions, his view of the situations where the purpose and basis of divine acts are controversial, and how he differs from the other Methodists are stated. In the third chapter, Al-Amidi's ideas and preferences about how to determine the reasoning and objections to invalidate the justification, as well as his thoughts and preferences, are presented. In the conclusion section, the interpretations of this study are stated.
