Protection and privacy of private life from the Constitutional Law

As technological and scientific improvements and protection tools developed against global threads require intervention into private life and as diversity of intervention methods increases, the protection of private life appears as one of the most important things among the individual rights and freedoms. Some special provisions have been envisaged in international documents, in the European Convention of Human Rights and in the constitutions and in other legislative norms as the need to those provisions has arisen.This dissertation (thesis) has been prepared in order to reflect the provisions of the Turkish Constitution on the protection of the right to private life with regard to international documents and the European Convention on Human Rights. It aims to scrutinize whether the existing provisions provide an effective protection against the diversity and the intensity of the interference into private life. It also aims to examine hardships faced in the protection of the right to private life, their reasons as well as the possible solutions.In the first chapter, the concepts on the confidentiality of the private life and its protection have been examined. In the second chapter, the confidentiality of private life and its protection in international scope and comparative law has been deeply examined. In the third one, the provisions of the Turkish Constitution on the right to private life has been scrutinized according to doctrine and application including inviolability of domicile, freedom of communication and the relevant legal provisions on the subject.The defects or the ambiguousness in the legal provisions have been detected on the protection of the right to private life and thus, some possible solutions have been tried to put forth in order to orientate lawmaker and practitioners.Key Words:1.
