Abstract (EN)

Terrorism constitutes great threat to global peace and security. Contemporary democracy, while fighting against terrorism, should strike the sensitive balance between security and freedom. The basic feature of contemporary democracies is to respect to rule of law and human rights. Success of fight against terrorism is up to conducting the mentioned fight on basis of rule of law and human rights. While, the Constitutional Court, on one hand, supervising the constitutionality of laws and decrees to the Constitution; the European Court of Human Rights, on the other hand, considering the claims on breach of European Convention of Human Rights, both indicate the legal principles of fight against terrorism and define the legal limits of war against terrorism. The unique character of this study has been sourced from targeting the contribution to the aim of ensuring superiority of concepts of rule of law and respect to human rights through the process of fight against terrorism in the light of judgments of Constitutional Court and European Court of Human Rights
