Abstract (EN)

In the world, the importance of cadastre is increasing day by day as the economic situation of the real estate. Cadastre has become a financial instrument and a fundamental component of the real estate market advancing beyond the system of keeping records of real estate. The value of real estate has gained considerable importance with planning. On the other hand the natural person or legal entity who will invest in real estate, they claim the guarantee of the investment. So and so, the right of property comes second after right to live in the European Agreement on Human Rights. It is now understood from the concept of cadastre that owners should know the positive and negative restrictions affecting property. For this purpose, it is necessary that data of all rights and liabilities on real estate should be secured by recording and this information should be shared whenever requested. It should be provided that be known of any kind of not seen obligatory-limiting rights and data about seen physical rights regarding ownership and be guaranteed by registering by state of this data. It is in demand how data in digital format affects property positive or negative in a short time. In this study, existing cadastral system in our country has been analyzed, the concept of land object, property and restrictive and limiting rights on property have been evaluated. In this thesis Çubuk district of Ankara has been selected cause of there are many data can be affecting land. The results of this study, property analysis of the selected region have been made. Limitations resulting from cadastral data, master plans, relationship between upper and lower scale subdivision plans and nonconcurrence between plan and parceling. It is seen that data has been produced and associated in a common coordinate system when relationship between property and master plans has been investigated. On the other hand mania line and water conversation basin plans have been located in different coordinate systems and raster data format. So an extra operation is needed to determine its restriction to property. Although a large number of archeological sites is in the workspace, these areas have not been take part in the development plans. The main problem appears in data producing and associating with property in the format of land object. Data produced by different institutions should be in a common standard and should be updated for overcoming an important problem of future cadastre. To know different restrictions on property and the positioning of the positive or negative impact on the property right is defined as "Land Object". As a result, it has the opinion that the concept of "object" supersedes the basic property unit "parcel". Key Words: Land Object, Property, Real Estate, Cadastre
