Military ombudsman: An evaluation for Turkey

This study examines a proposed "Military Ombudsman" model within the Turkish Armed Forces (TAF). Although modern democratic societies feature civilian or general ombudsman institutions, the strategic and security factors inherent in the military sphere necessitate mechanisms that enable the military to be independent and open to external oversight. While the TAF currently has internal inspection and disciplinary systems in place, there remain observable areas for improvement in terms of personnel's right to seek redress and institutional transparency. In this study, the legal and institutional foundations of the military ombudsman institution are detailed, along with definitions of its duties and authorities, as well as its operational procedures. It is argued that existing legislation, such as Law No. 5018 on Public Financial Management and Control and Law No. 1325 on the Duties and Organization of the Ministry of National Defense, does not provide a clear legal framework for a military ombudsman. Consequently, either a dedicated law or comprehensive legislative amendments would be needed. Emphasis should be placed on the impartiality and legitimacy of the ombudsman, who should be elected by qualified majority through parliament or an independent board. The scope of duties ranges from investigating allegations of injustice experienced by both TAF personnel and civilians as a result of military administration to overseeing the legality of financial expenditures. It is recommended that the reports produced be submitted periodically to the Grand National Assembly of Türkiye and disclosed to the public (while preserving relevant security classifications). In conclusion, the proposed military ombudsman aims to contribute to the TAF's attainment of a structure that is accountable, transparent, and respectful of human rights, in line with national and international norms.
