Abstract (EN)

Titled as "Applicable Law to Succession With Foreign Element Within The Frame of European Union, English and Turkish Laws", our study consists of three chapters. Increasing international succession disputes due to population mobility and tendencies towards acquisition of properties in foreign countries and countries' different systems for settlement of these issues, have been the main reason for us to study on this subject. In the introduction of our study, succession in substantial law, succession with foreign element and renvoi issues have been examined in general. Under the following titles, unity, scission and mixed systems and international agreements on succession with foreign elements have been discussed. In the first chapter, applicable law to succession with foreign elements in EU Succession Regulation have been examined and to be able to understand the subject, EU's previous steps have been explained as well. Following that, United Kingdom's system on international succession have been enucleated. In this part, explanations on UK's substantial law have been given, considering the discrepancies betweenTurkey and UK's substantial laws. In the last and second chapter of the study, applicable law to succession with foreign element have been explained. In this chapter, succession in substantial law and succession with foreign elements have been discussed and after that applicable law to these issues in Turkish law have been given in detail.
