Abstract (EN)
In today's world, where multi-level legal structures and transnational judicial institutions are growing, coordinating different legal orders has become more important than ever. This research examines the fundamental question of how constitutional pluralism works in Europe and investigates its implications for the multi-level European legal order. The thesis primarily focuses on the theoretical and practical analysis of the interaction between the constitutional courts of EU member states and the Court of Justice of the European Union (CJEU). The analytical research method is based on a critical review of theoretical sources, legal documents, and prominent judicial opinions. This study reveals that constitutional pluralism simultaneously provides the capacity for legal coexistence and respect for the diversity of national legal systems while creating fundamental challenges in interpreting fundamental rights, institutional competence limits, and the legal unity of the European Union. Practical examples, such as the Taricco, Weiss, Melloni, and Solange cases, illustrate interpretive and institutional conflicts between national and supranational levels. The research concludes that constitutional pluralism's sustainability and effectiveness in Europe depend on creating interpretive, institutional, and dialogue-based frameworks that balance national legal autonomy and EU legal order coherence.
