Abstract (EN)

The European Court of Justice's exclusive jurisdiction about European Union law and the autonomy of European Union constitutes the most important point of the European Union's accession to the European Convention on Human Rights. The main reason of making frequent negotiations and new arrangements is ensure the accession without undermining the EU's autonomous legal order. The purpose of the study is evaluating the relationship between the accession, Accession Agreement and the autonomy of European Union. In this direction, the relation between European Union and European Convention on Human Rights has been identified and the emergence of accession idea and the situation until the accession negotiations has been examined in the first chapter. The second chapter concentrates on the content of the Accession Agreement and the examination of the characteristics of European Union law with rights and obligations that will arise after the accession. The last chapter examines which manner the European Union law and institutions will be affected and how the interaction between European Court of Justice and the European Court of human rights will change after the accession.
