Concept of national sovereignty in the European Union membership process

This study analyses EU as a legal subject, harmonisation of the EU Law in Member States and Candidate Countries and the effects of Turkey?s EU membership on the Turkish legal and constitutional system. EU membership has many aspects related to the law, beyond economic issues. Harmonisation which is an important instrument to create a common legal system in Member States, can reach to its objectives only by timely transposition is done and national measures which are applicable for national authorities. Besides that, as many candidate countries have done in the past, Turkey has to issue the constitutional ammendments before the accession in some legal issues like the transfer of some powers derived from national sovereignty to the Community and the primacy and directly applicablity of EU Law. For granting a place in the new legal context as a result of the accession, Turkish laws and regulations has to change its existing traditions especially from the sovereignity aspect, in a radical way.
