Abstract (EN)
The subject of the thesis is how to interpret and understand Article 5 of the European Convention on Human Rights (ECHR) regarding right personal security by European Court of Human Rights (The Court). In this study, Article 5 of the ECHR is analyzed in accordance with the case law of the Court. In this context, following matters are tried to explain: what safeguards should be provided by judicial authorities and law enforcement agencies to a person deprived of liberty; and what situations constitute violation against personal security. In the first part of this study, the scope of the concept of liberty and personal security is tried to be specified. In second part, it is explained in which situations the right to liberty and personal security could be restricted in accordance with paragraph 1 of Article 5 of ECHR. The third and final part consists of what rights and legal guarantees is given to the people deprived of their liberty in line with paragraph 2-5 of Article 5 of ECHR.
