The relationship between growth and environmental right in the light of case examples of The European Court of Human Rights: An examination for the period of 2000-2012

This research examines the relationship between environmental rights and growth, which is still one of the most important agenda items, which has been brought to the international agenda since the 1970s, especially through the Stockholm Conference, in the light of case studies of the European Court of Human Rights (ECHR) over the period 2000-2012. Thus, with this research, it is aimed to reveal that the legal basis on which the environmental right is evaluated in the ECHR judgments and for which economic reasons, Whether there is sufficient jurisprudence to ensure that the right to the environment is contained in an independent article and the European Convention on Human Rights, also the relationship between growth and the right to the environment. Historical and descriptive analysis were included in the research. Electronic and printed sources, newspaper news and social media agendas were used in the process. In addition, the information produced by the researcher was evaluated using qualitative analysis and verbal analysis. This research, which is based on text / document analysis, was translated into the ECHR's case-related decisions, and then these decisions were interpreted and analyzed in terms of "environmental law. As a result of the research; Within the framework of the case decisions of the ECHR that there is a negative relationship between environmental right and growth, depending on growth and economic activities increased violations of environmental rights, on the other hand, it has been found that there is sufficient and strong case-law in the ECHR for the effective use and protection of the right to the environment with an independent article.
