Abstract (EN)

After huge destruction caused by the Second World War, Europeans initiated processes to prevent future wars and dictatorships. They firstly recognized the inherent dignity and inalienable rights of members of the human family. They proclaimed the European Convention of Human Rights in order to introduce a new world in which human beings shall enjoy freedom of speech and belief, and freedom from fear. Because they saw that the disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind. In this context, they accepted the right to a fair trial for their citizens in the determination his/her civil rights and obligations or of any criminal charge against him/her, they recognized for everyone a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. This study intends to show the content and level of efforts of developing human rights. First, implementation areas of and rights those are included in the European Convention of Human Rights are examined. Second, the right for a fair trial arranged in the Convention is analyzed. In this framework, the subject, content and factors of the right for a fair trial is explained. Third, this study evaluates some decisions of the European Court of Human Rights based upon applications made against Turkey. Finally, this study is ended with a section of conclusion and suggestions about the subject.
