European Convention on Human Rights policy at the torture ban ray and Turkey application

In supra national human right acts, some concepts such as degrading, inhuman or cruel act or punishment, are provided with respect to torture. Even though, these concepts are not as violent as torture, they are evaluated as torture. Although, it is not easy to seperate these concepts from each other, decisions of Court of Europe on Human Rights (COE) shall be very useful and helpful for national judges.Torture, having been used as a penalising method or evidentiary tool at the begining, has become the subject-matter of many international documents as an absolute law during the historical process. However, existence of torture prohibition withhin the international documents and national legislation could not suffice to prevent torture events in practise.We wished to make some contrubition to fighting against torture by the thesis.
