The purpose of this dissertation, entitled ?The Effect of the European Convention on Human Rights on the European Union Law?, is to analyse the activities of the European Union concerning human rights, the effect of the Convention on these activities and Union?s accession process to the European Convention of Human Rights.Becoming of human rights more important in the international platform has led the European Union to work on this area. In this context, the European Court of Justice, to draw inspiration from constitutional customs of the member states and the human rights conventions of which the member states are a party, awarded ruling case regarding the protection of the fundamental rights. The European Court of Justice has generally refered to the European Convention of Human Rights because all of the member states of the Union are a party of the Convention. The member states criticised that the awards of the The European Court of Justice not to be based on a catologue of fundamental rights and this criticism led the preparation of the Charter of Fundamental Rights. This Charter has a binding force with the Treaty of Lizbon which comes into effect in 1.12.2009. This Treaty also envisages becoming a party of the Union to the European Convention of Human Rights and efforts are underway to become the Union party of the Convention.In the beginning section of the dissertation the historical period of human rights and the activities about protecting the human rights around the world are mentioned.The first chapter of the dissertation mentions the attempts aiming to protect human righst of the European Union Parliament, the Council, the Comission and the other institutions and the European Union legislation on human rights.The second chapter of the dissertation analyses the constitution process of the Charter of Fundamental Rights within the framework of the European Court of Justice decisions and the relationship between the Charter and the European Convention of Human Rights.The last chapter evaluates the judicial power of the European Court of Justice and European Court of Human Rigths and activities performed by the European Union in order to advance the protection system of the fundamental rights.Key Words: European Union, Human Rights, European Court of Justice, Charter of Fundamental Rights, European Convention of Human Rights.
