Abstract (EN)
Right to fair trial expresses that, in the determination of his civil rights and obligations or of any criminal charge against him, everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal established by law. While the criminal conflicts are resolved, the judge reaches his conscience conviction only through the facts established at the trial. Therefore, first condition of giving a right decision at the end of a trial process is the realization of a right trial. Hence, the requirements of the fair trial right of the accused should be taken into consideration during the trial, and the process has to be conducted in accordance with fair trial principles.
