The termination of legal services agreements and their legal consequences

In modern times, individuals involved in legal disputes require the assistance of attorneys who possess expertise and experience in the field of law. According to the Attorneyship Law, legal services provided by attorneys are considered a public service. Due to the trust-based nature of this relationship, even if the legal services agreement is terminated, in certain situations, the attorney may be required to continue their duties for a specified period. Defining the legal characteristics of the legal services agreement, identifying its essential elements, clarifying the parties to the contract, specifying the obligations of the parties, and outlining the consequences in the event of termination hold significant importance today. In our study, the profession of lawyering and its historical background are initially explained. Subsequently, the constitutive elements of the contract, formal and evidential requirements, and comparisons with similar contracts are analyzed to examine the legal nature of the attorney agreement in detail. In the contract, one party is always the attorney, while the other party is the client. The reasons for termination of the attorney agreement are divided into two as termination by the parties and automatic termination. The reasons for termination by the parties are; termination by mutual consent, dismissal and resignation. The reasons for automatic termination are; performance of the work subject to the contract, expiration of the term, death of one of the parties, loss of capacity of one of the parties, loss of attorney status, bankruptcy. This study aims to provide a detailed analysis of the reasons for the termination of attorney agreements, as well as the legal consequences and implications of such termination.
