Abstract (EN)

The aim of this study is to compare the Azerbaijani family law with the Islamic family law. In this study, the concept of family in Azerbaijan and Islamic law is examined, while the provisions on marriage, marriage, divorce and alimony are examined, the Azerbaijan Family Code and the relevant views of the sects in the Islamic religion are examined comparatively. In Azerbaijan, there is a structure that attaches importance to the concept of family with the influence of its culture from the past. In the country where the extended family structure is dominant, there is a patriarchal structure dominated by men. Today, although extended families have been replaced by the nuclear family consisting of mother, father and child, the influence of family elders on the family still continues. The value given to the family in Azerbaijan is reflected in the provisions of the Family Code. Similarly, the concept of family is given importance in the religion of Islam; The structure, establishment, protection and maintenance of the family are considered important. The family structure and the duties of men and women are clearly revealed in the Qur'an and the hadiths of the Prophet Muhammad. It is expected that concepts such as love, respect, tolerance and healthy communication of the Islamic religion will also be present in family relations. In addition, it is a guide in explaining the importance given to the family in the religion of Islam, where the Prophet Muhammad lived with his family.
