Abstract (EN)

Commercial enterprises are run by the owners of the business. However, given all the volume and scope of their activities, the owners of the business may sometimes not be able to drive the enterprise by themselves. Therefore, the owners of the business exploit labor and time of some people within growing division of labor. These people are called "commercial representatives". Commercial representatives examined as part of our work are connected to the owners of the business and have the ability to represent them. The commercial representatives have the capacity management and representation in commercial enterprises. It is necessary for them to use these skills in a manner appropriate to the interests of the owner of the business. However, because of the authority they have over the time, there is a possibility for commercial representatives who learned the trade secrets and that recognize the customer to use this information in a manner contrary to the interests of the owners of the business. Especially in case of rivalry, it will cause damage to the interests of the owners of the business using this information. Legal institution that protects the relationship of trust and that will reduce the risk of damage is prohibited competition. Prohibition of competition for commercial representatives were analyzed in this study in terms of legal and contractual prohibition.
