Abstract (EN)
Rights and liabilities imposed on both parties by a press employment contract serve to actualise the freedom of press. Press employment contract, by definition, differs from standard employment contracts in many ways. In a democratic system, press employment contracts are typically weaker than other types of employment contracts in terms of legal subordination. Regarding the obligation of compliance to the mandates and instructions of the employer, the most important factor that distinguishes journalists from other workers is freedom of the press. In cases of conflict between public interests and employer's interests, in order to determine which one the journalist should favour, the boundaries of the journalist's duty of loyalty must be laid off within the context of freedom. In disputes that arise from the conflict between the interests of freedom of the press and the protection of personal rights, determining which of the two conflicting interests is worthy of protection also serves as a guidance to determine whether the journalist meticulously fulfils their duty to work. In order to ensure that the journalist can fulfil their duty to work within the context of freedom of the press, the employer is obliged to compensate the journalist, protect and look after the journalist's personal rights, take all necessary occupational health and safety precautions, provide them with the necessary tools and equipment, and cover all the expenses made by the journalist in their process of accessing information. In the first chapter of our thesis, we will examine the press labour law and press employment contracts. In the second chapter, journalist's obligations derived from press employment contract, freedom of the press under the European Convention of Human Rights and the limits of intervention to freedom of the press will be examined. In the third chapter, we will be examining the obligations of employer derived from press employment contract, in the context of freedom of press.
