Abstract (EN)

Surety is a personal guarantee contract of secondary nature and the responsbility of the guarantor shall be terminated in case the actual debt is terminated. The surety contract of indefinite duration exists in cases where the liability of the guarantor has not been limited by a certain duration and the reasons for termination of the surety contract is also applicable here. The contract of surety may be terminated by intrinsic reasons independently from the actual debt. In certain cases, the liability of the guarantor shall be decreased although not terminated. Our study aims to investigate the reasons which terminate or decrease the responsbiility of the guarantor in surety contracts of indefinite duration. Therefore, the reasons terminating the responsibility of the guarantor based on the actual debt or the surety contract have been examined separately.
