Abstract (EN)

In tihs study, the crime of theft committed by using information systems regulated in subparagraph e of paragraph 2 of article 142 of the Turkish Penal Code No. 5237 and the crime of fraud committed by using information systems in subparagraph f of paragraph 1 of article 158 were examined. As a result of the aforementioned crimes being included as the qualified form of theft and fraud crimes and the mixed system adopted by the law for cybercrimes, it required to be approached from the framework of informatics, theft and fraud crimes, and these types of crimes were outlined in separate sections. Thus, it is aimed to determine the distinguishing elements of theft and fraud crimes committed by the use of information systems and considering the debates brought about by the qualified form of these crimes, which constitute the subject of our thesis, and the hesitations in practice, some evaluations have been made about whether the torts against digital assets, which are of great economic importance, are met with these articles.
