Özet (EN)

Today with increasing in international relations, parties bring many divorce and seperation cases before the courts. Thus, in these cases containing a foreign element, it is crucial to analyse applicable law to divorce and seperation and also their secondary results; alimony and custody.This study aims to analyse how the territorial regulations about divorce and seperation, show the effect of their differences in our domestic law. The first part of the study, I examined the matter of divorce and seperation in the area of substantive law. In the second part of our study; I examined applicable law entirely by discussing the reformings of new International Private and Procedural Law and the conflict of laws rules in various jurisdictions. In the third part of our study; I focused on the applicable law in alimony and custody. By examining the international conventions, I wanted to analyse to which provisions will be applied.In the final part of the study; I put forth contentions and proposed solutions.Key Words:1.Foreign2.Divorce3.Seperation4.Alimony5.Custody
