Abstract (EN)
The tendency of alternative dispute resolution methods has increased recently as going to law in the settlement of disputes leads to a long, expensive and disruptive process. Mediation is the most preferred one of these methods. Mediation referring to the process that the partners of the dispute try to bring a matter to a solution by coming together with the participation of the mediator, importial and independent stranger, for the purpose of talking and negotiating may be applied in private legal disputes on which the partners may freely dispose within the context of mediation law in legal disputes. A large part of the disputes concerning family law is related to the public order and it is not possible to freely dispose on the partners. Divorce is also one of such family law disputes. The implementation of mediation in divorce and post-divorce disputes has importance in terms of configuration the communication between divorced spouses, maintaining personal relationships and raising common children in a healthy environment. In this study, after giving information about the concept of mediation in Turkish law, the applicability of mediation in disputes related to the legal consequences of divorce is examined. The legal consequences of divorce are considered as personal and financial consequences for spouses and children.
