Carl Schmitt's Nomos thought and legitimacy foundations of the modern border walls

In order to prevent the passage of terrorist activists and illegal immigrants, many states are now covering the borders with walls. This study is related to the border walls of nation states which are part of the global world, claiming to be universal, multicultural and cosmopolitan. This thesis advocates that there is a harmony between the legitimacy foundations of the border walls and the ideas of legitimacy and nomos of Carl Schmitt which is developed in his works, such as "The Nomos of The Earth", "Land and Sea", "The Concept of Political", "Legality and Legitimacy", "The Crisis of Parliamentary Democracy" and "Political Theology". The study based on Schmitt's political philosophy, provides a critical insight into the walls rising on the borders of at least one nation state on almost every continent, including western democracies. The background of the fear of death which is the essence of existence of the border walls, will be explained by the phenomenons of nomos, sovereignty and decisionism in Schmitt's state theory. In this context, focusing on the relationship between security demand and state sovereignty, it will be determined that the legitimacy of the rising border walls in the global world is derived from state sovereignty. As a result, in this study, Schmitt's thoughts counter to liberal, pluralist and liberal democracy, will be put forward together with the theories of the thinkers who influenced Schmitt's philosophical theory. This thesis justifies that there is a composition between the nomos phenomenon which exceeds or includes the envisaged written law and the legitimacy grounds of the border walls. Unlike the earlier studies focused on the latent reasons behind the official discourses, this study interests the phenomenons such as terrorism and immigration which is presented by the official state representatives. This study, with reference to Schmitt's theory, justifies that the border walls that exist as a response to the fear created by the need of openness of global world indicate the space of political unity and it's indicative of political sovereignty in the thought of classical sovereignty.
