La responsabilité pénale d'entreprise dans les infracions contre l'environnement

Nowadays, the level of pollution increases unceasingly by the activities of the companies and the political, economic, social and legal precautions are not sufficient to decrease it. Consequently, under the conditions of high competition, their economic activities which are not subject to the regulations, by degrading environmental quality, started to threaten the human life.The objective of this memory is, while taking into account the structure and the causes of an environmental crime, to identify, within the framework of the Turkish law, the persons in charge for such a crime committed by the companies and to determine the sanctions to apply.Our study shows clearly that the Turkish criminal law, in its current status, has an inefficient punishment system with regard to the protection of environment, and that it gives the priority to the economic interests and not to the environmental values.
