Abstract (EN)

The purpoese of this thesis is to make an account of probation as a criminal justice system which can be traced back to centuries ago and emerged as a way of implementation of modern concept of punishment that can be summarized as rehabilitation and reintegration of criminals after the realization of negative effects custodial sentences. Probation, in the beginning, was used to mean the conditional suspension of trial or verdict, but over time, developed to become a concept about the process of emancipation of criminals under the custody of officer during the criminal justice process. The first part of the thesis contains the emergence and principles of probation, while the second part depicts the Anglo-saxon practice of probation. The last part of the thesis includes the position of probation in Turkish criminal justice system, the emergence and development of probation in Turkey and the main principles of practise and problematic issues of probation.
