Abstract (EN)
This thesis analyses in detail the preventive measures which haveestablished their place in the sanctions system as a result of thedevelopments in penal law. The preventive measures, which have onlyrecently entered into the Turkish Penal Code, have essential roles to playagainst the people who are potentially dangerous to the society as well asto rehabilitate them into the society.In our study, we initially focus on the concepts of crime and criminalsanctions, and then give a concise account of the historical development ofcriminal sanctions which constitutes the bases of the emergence of thepreventive measures. In the following section of the first part, the natures ofthe penal and preventive measures which are both the main elements of thesystem of sanctions are described. Moreover, the similarities anddifferences between the penal and preventive measures are also explained.In the second part, we have examined the preventive measures inthe new Turkish Penal Code between articles 53-60. Finally we makesome proposals for the further improvement of these articles in the light ofthe observations made in the first part of this thesis.
