ABSTRACTMaster ThesisInspection of Human Body During Criminal ProcedureYener YILDIRIMKALDokuz Eylul UniversityInstitute of Social SciencesDepartment of Public LawIt can be proposed that the most fundamental objective of the criminal procedure andthe real reason of making a judgment is to reach the material truth. One can claim that the?justice is done?, only if the perpetrator is determined and sentenced legitimately. Moreover,reaching the material truth is not the only dominant principal in the criminal judgment.Therefore, contemporary criminal procedures shall maintain the approach that thesuspect?s rights and obligations are an active part of the judgment and ensure that the humanrights are not violated, in the course of struggling for reaching the material truth.We believe that, this deep change in the methods shall start with believing in the pre-requisite of ?reaching the suspect by way of evidence? instead of ?reaching the evidence byway of suspect?; and complying with the principles of ?Proportionality and Subordination?.
